INTERPRETATION

"we", "us", "our" means Healthcounter Ltd registered office 5 Peterwood Park, Croydon, CR0 4UQ. Registration Number 06646711
"you", "your" means the person ordering products under these Terms & Conditions.
"working days" means all days other than Saturdays, Sundays and public holidays.
"goods" means the products you have ordered from us

THINGS YOU SHOULD KNOW BEFORE PLACING AN ORDER

Placing orders for goods on this website means that you agree to be bound by the most current Terms and Conditions (T&C). T&C may be changed at any time by us and we will include a note on the homepage to notify you that changes have been made so you may check them. You will accept that you will have no claim for breach of contract or otherwise in respect of such alteration.

You must be over 16 to use the website and over 18 to purchase medicines

The contents of this web site are presented for information purposes only. The material is not a substitute for professional medical advice. It is designed to support, not replace, the relationship between you and your health care providers. The materials in this web site cannot and should not be used as a basis for diagnosis or choice of treatment. Always read the all the product packaging and labels of any items purchased.
We reserve the right to refuse access to the Website, remove or edit content and cancel orders at our discretion.
You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of your order or any content.
Please remember that you are solely responsible for all electronic communications and content sent by you to us; check your Spam folder in case any of our communication is diverted there.

2. Our Contract With You

Our contract with you is defined by these T&C.
When you place an order on our website, this represents an offer by you to buy products from us. We have accepted this offer only when you are notified by us that the order has been dispatched and not when payment is taken.The contents of this web site are directed solely at those who access the site from the UK. Your use of this web site and any purchase by you on this web site of any products is governed by English Law and will be deemed to have taken place in England and subject to the exclusive jurisdiction of the English courts. Risk and title in the products will pass to you when they are despatched by us to you, from the UK, and you acknowledge and agree to be responsible for complying with any restrictions around the receipt and use by you of the products.

Our responsible pharmacists have a duty of care to all our customers. Please do not be offended if you receive an email or telephone call about your order; it is to ensure that medicines are used safely and according to their over the counter license and to decrease the likelihood of medicine duplication. They may also be able to signpost you for extra help and support.

3. Price and Payment
We also endeavor to offer the best possible value for money on the internet.
All items are available for purchase in the United Kingdom. Overseas customers are required to check before ordering a product to make sure that it can be lawfully purchased and shipped.
Prices shown are inclusive of VAT but they exclude any delivery costs. All fees are made clear before checkout is complete.

Payment for the products is due immediately upon the placing of your order online. Payment is accepted by credit and debit card, PayPal and SagePay.
Nothing will be dispatched until any payment made has cleared and been received by us. You will receive confirmation that the transaction has been received, has been authorised and that your card has been debited. You will also receive a reference number with this confirmation which will be required for any future correspondence.
The cost of your order may be amended if you've incorrectly selected a delivery option or the chosen delivery option is unavailable.

4. Availability:
We endeavor to ensure our website is up to date with product availability. If an item is unavailable for your order for more than 24 hours, we will e-mail you. If products are unobtainable we will notify you.

5. Delivery
Certain countries place restrictions on the types of products that may be posted into them. In instances where your order is seized by customs, MyPharmacist.co.uk will not be able to offer a refund or resend orders not delivered under these circumstances. When ordering products from a country outside the UK, all customs responsibilities are borne by you the buyer; you are the importer of the medicine/product and so charges levied by customs in the delivery country are your responsibility. We do not send orders to America or Canada.
Your use of this web site and any purchase by you on this web site of any products is governed by English Law and will be deemed to have taken place in England and subject to the exclusive jurisdiction of the English courts
Please note we will not send dangerous goods through the post e.g gases or flammable items and any aerosols sent are within the UK only.
The cost of your order will be amended if you've incorrectly selected a delivery option or the chosen delivery option is unavailable. We will take payment via SagePay after we have contacted you about this problem or send you a PayPal request.
Within the UK, parcels over 2kg will be sent by courier and will incur extra costs. If your order goes over the Hermes weight allowance, you will be contacted by email about the extra charges; we will search our couriers for the best price for you.

6. Returns and Refunds
We cannot accept returns of medicines. If you return medicines to us we will dispose of it correctly since they cannot legally be resold.
If we have sent you an incorrect product or it is faulty or damaged we will accept returns provided you contact us within 2 days of receiving the order and we receive the product back within 30 days. Once we have received the returned item we will refund the amount paid or resend the product.

All UK parcels are sent 48 hour tracked and should be received within 3-4 days at the outside. If your parcel isn't delivered you must let us know withing 5 days of it's expected delivery. We will contact Hermes to establish where your parcel is. We will need to wait 21 days before your parcel is declared lost by Hermes since there is a chance it will be delivered in that time. In this case we may choose to refund the order rather than re-send.

7. Quality
We only sell medicines that are licensed for use in the UK. We only buy direct from the manufacturer or from a wholesaler here in the UK. Fake medicines are a menace and can seriously damage you or your family's health.
Please use, handle and store all products as per the manufacturer's instructions. Always read the Patient Information Leaflet or packaging of any medicine.
Please refer to our Returns and Refund Policy if you receive incorrect products or they were damaged in transit.

8. Privacy and Security
By using our Web site, you consent to the collection and use of certain information by MyPharmacist.co.uk.
We are committed to protecting your privacy. We only use the information we collect about you to process & track orders, provide a more personalised shopping experience and to make sure your medicine choices are safe and suitable.
When you order, we ask you for your email contact, postal address and your payment details. This allows us to process and fulfill your orders and to keep you notified of how your order is progressing. We also ask for your daytime telephone number which enables us to contact you urgently if there is a problem. We use Hermes, Royal Mail and couriers and your telephone details and/or email address will be shared with them to enable you to receive detailed information about your parcel tracking progress.
We may also monitor customer traffic patterns and site usage to help us develop the design and layout of the site.
Furthermore, to ensure compliance with the UK Data Protection Acts of 1984 and 1998 and the relevant Irish legislation, we follow strict security procedures in the storage and disclosure of information which you have given us to prevent unauthorised access. Our security procedures mean that we may occasionally request proof of identity before we are able to disclose sensitive information to you.

We can’t always guarantee that access to our website will be uninterrupted or transmissions will be error-free, due to the nature of technology. Also repairs, maintenance, or the introduction of new facilities or services may interrupt services. We will work hard to minimise the frequency and duration of any interruptions.

Any relations you have with such companies are contracts outside the scope of our contractual relationship.

WEEE
The United Kingdom is under an obligation to minimise the disposal of Waste Electrical and Electronic Equipment (WEEE) in domestic waste and encourage recycling, recovery and environmentally sound disposal. MyPharmacist is committed to promoting the reuse, recycling and recovery of WEEE by contributing to the appropriate compliance schemes. Certain electrical items can not be disposed of in domestic waste but disposed of through an approved WEEE take back scheme. Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination-harming wildlife and also human health.
